CENTER OF THE AMERICAN EXPERIMENT

 

POLICY REGARDING POLITICAL CAMPAIGN ACTIVITIES

 

 

THE FOLLOWING POLICY WAS ADOPTED BY UNANIMOUS RESOLUTION OF THE BOARD OF DIRECTORS OF CENTER OF THE AMERICAN EXPERIMENT, A MINNESOTA NONPROFIT CORPORATION, ON JULY 24, 2006:

 

 

        WHEREAS, the Corporation is a public educational charity and a tax exempt organization described in Internal Revenue Code Section 501(c)(3); and

 

          WHEREAS, the Board of Directors of the Corporation has determined that it is in the best interest of the Corporation to adopt a formal written policy regarding political campaign activities by or on behalf of the Corporation which might jeopardize the tax-exempt status of the Corporation;

 

 

          BE IT THEREFORE RESOLVED as follows:

 

1.       It shall be the policy of the Corporation to strictly abide by the requirement in Section 501(c)(3) of the Internal Revenue Code and in Article V of the Articles of Incorporation of the Corporation that the Corporation not participate in, or intervene in (including the publishing or distributing of statements), any political campaign on behalf of (or in opposition to) any candidate for public office.

 

2.       The Corporation shall not engage in any of the following activities:

 

a.       Endorsing any candidate for public office;

b.       Donating or contributing any funds or property to the campaign of a candidate for public office;

c.       Participating or engaging in political fundraising events;

d.       Distributing statements for or against any particular candidate for public office;

e.       Engaging in any other activity that may favor or oppose any candidate for public office.

 

3.       No director, officer, employee, staff worker, volunteer or other representative of the Corporation shall engage in any of the foregoing activities on behalf of or in the name of the Corporation, nor engage in any of the foregoing activities on the property of the Corporation or during any Corporation function or event.

 

4.       No director, officer, employee, staff worker, volunteer or other representative of the Corporation shall use any of the Corporation's facilities, office space, telephones, computers, databases, internet access, postage, stationery, copiers, or other equipment or supplies for any activities related to political campaigns of any candidate for public office.

 

5.       No employee or other paid staff of the Corporation shall engage in any activities related to political campaigns of any candidate for public office during time for which he or she is compensated by the Corporation.  Any time spent by such persons on any such activities during regular work hours shall be strictly reported and accounted for as paid time off or unpaid time off.

 

6.       If any director, officer, employee, staff worker, volunteer or other representative of the Corporation, in his or her capacity as a private citizen and not as a representative of the Corporation, writes an article, essay, opinion piece, letter to the editor or similar submission, gives an oral presentation or interview, or otherwise publicly expresses an opinion which directly or indirectly involves support of or opposition to a candidate for public office, and if the position or involvement of such person with the Corporation is identified in connection with such public expression, he or she shall include a statement clarifying that such expression is made in his or her personal capacity and not on behalf of, or as a representative of, the Corporation, and shall request that any parties involved in such publication or presentation avoid creating any impression that the public expression is made by such person on behalf of, or as a representative of, the Corporation.
