The U.S. is experiencing a minerals emergency thanks to our lengthy and litigious permitting process and our history of making lands off-limits to exploration.

Since 1995, critical minerals imports (the 50 minerals the U.S.G.S. designates as “at risk” of supply chain disruptions and needed for the economy) have doubled. In 2024, the U.S. was 100% reliant on imports for 12/50 critical minerals and the U.S. was more than 50% reliant on imports for 28 of them.

The U.S. imports 95% of all rare earth elements, with China the source of 74% of them. This is a national security risk, with the Center for Strategic & International Studies writing in February 2025 that the U.S. “would likely run out of some weapons… in less than a week” in the event of a confrontation with China over Taiwan.

H.R. 4090 codifies parts of the Trump executive orders so that these steps can’t be undone by a later administration.

  • Sets the policy of the U.S. to be a leading minerals producer
  • Requires the Secretary of the Interior to evaluate the costs associated with our current import reliance.
  • Requires Interior Secretary to provide a list to Congress of projects that can be immediately authorized and help expedite approvals.
  • Requires Interior Secretary to provide a list to Congress of all Federal land that “may be suitable for leasing or development” of a mining project.
  • Requires Secretary to identify burdensome federal regulations with input solicited from mining industry, as well as prepare a review of local and state statutes.
  • Requires and accelerates detailed geologic mapping of U.S., which is crucial for more exploration.
